Message Board Guidelines and Terms of Service

It is a condition of your use of the message board and this Web site that you do not:

• Restrict or inhibit any other user from using and enjoying the Web Board.
• Post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane, or indecent information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national, or international law.
• Post or transmit any information, software or other material that violates or infringes upon the rights of others, including material that is an invasion of privacy or publicity rights or that is protected by copyright, trademark, or other proprietary right, or derivative works with respect thereto, without first obtaining permission from the owner or right holder.
• Post or transmit any information, software, or other material that contains a virus or other harmful component.
• Post, transmit, or in any way exploit any information, software, or other material for commercial purposes, or that contains advertising.
• You understand that the Foundation Center has no obligation to monitor the PND message board. However, the Foundation Center reserves the right at all times to disclose any information as necessary to satisfy any law, regulation, or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, that in the Foundation Center's sole discretion are objectionable or in violation of these terms and conditions. The Foundation Center will investigate all legitimate complaints of violations of these guidelines.

• To release current or past user information if it believes that a user's account is being used to commit unlawful acts, if the information is subpoenaed, and/or if the Foundation Center deems it appropriate;
• To deny access to Foundation Center message boards to serious or repeat offenders of the Foundation Center's Content Guidelines or Terms of Service;
• To deny access to Foundation Center message boards to users for conduct that the Foundation Center believes is harmful to other users or to the Foundation Center as a business;
• To deny access to Foundation Center message boards to users who interfere with the design and operation of the Foundation Center Online without written authorization;

Under no circumstances, including, but not limited to, negligence, shall the Foundation Center be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of, or the inability to use, Foundation Center materials. You specifically acknowledge and agree that the Foundation Center is not liable for any defamatory, offensive, or illegal conduct of any user. If you are dissatisfied with any material on this site, or with any of the Foundation Center's terms and conditions, your sole and exclusive remedy is to discontinue using the Foundation Center Online.
